NineWise ("NineWise," "we," "us," or "our") is operated by Jaime Elizondo Basurto ("the Company"). NineWise provides AI-assisted practice and feedback for the CELPIP test (Canadian English Language Proficiency Index Program) through the website ninewise.ca (the "Service") to users primarily located in Canada.
By creating an account, purchasing a Sprint, or otherwise using the Service, you agree to these Terms of Service ("Terms"). If you do not agree, do not use the Service.
NineWise is an independent study tool. NineWise is not affiliated with, endorsed by, or sponsored by Paragon Testing Enterprises. "CELPIP" and "Canadian English Language Proficiency Index Program" are registered trademarks of Paragon Testing Enterprises. We reference them solely to describe the test our Service helps users prepare for.
NineWise uses artificial intelligence (including third-party AI models) to:
NineWise scores are estimates for practice purposes only. They are generated by AI models and are not produced, reviewed, validated, or endorsed by Paragon Testing Enterprises or any official CELPIP examiner. Your actual CELPIP exam score may differ — higher or lower — from any score or band estimate NineWise provides. NineWise does not guarantee any specific exam outcome, band score, or Express Entry/PR result.
Sprint purchases are final and non-refundable, except as expressly provided under the Second-Attempt Guarantee described in Section 7. By completing a purchase, you acknowledge that you are buying immediate digital access (evaluations and a time-limited access window), and that no general right of refund, cancellation, or cooling-off period applies once access has been granted, to the extent permitted by applicable law.
If you believe you were charged in error (e.g., a duplicate charge or a technical failure that prevented you from receiving access), contact us at hello@ninewise.ca and we will review the issue in good faith. See our full Refund Policy for details.
This guarantee applies only to the Sprint 60 plan and is subject to all of the following conditions:

We may suspend or terminate accounts that violate these Terms, including free accounts used to repeatedly evade evaluation limits.
All content, design, branding, source code, and proprietary scoring logic of the Service are owned by Jaime Elizondo Basurto or its licensors. You retain ownership of the text and audio you submit ("Your Content"), but you grant us a license to process Your Content through our systems and third-party AI providers solely to provide the Service to you (see Section 10 and the Privacy Policy).
To provide scoring, transcription, and feedback, NineWise sends your submitted text and/or audio to third-party AI providers (currently including Anthropic and OpenAI) for processing. See the AI & Voice Data Processing Notice for details on what is sent, why, and how long it is retained.
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT, TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW.
We do not guarantee that AI-generated scores, feedback, or transcriptions will be accurate, complete, or representative of your actual CELPIP exam performance. To the fullest extent permitted by law, Jaime Elizondo Basurto's total liability arising out of or relating to the Service shall not exceed the amount you paid us in the twelve (12) months preceding the claim.
Nothing in these Terms limits liability that cannot be limited under applicable consumer protection law.
We may modify, suspend, or discontinue any part of the Service, and may update these Terms from time to time. If we make material changes, we will post the updated Terms with a new "Last updated" date. Continued use of the Service after changes take effect constitutes acceptance of the revised Terms.
These Terms are governed by the laws of Mexico, without regard to conflict-of-law principles.

This Privacy Policy explains how Jaime Elizondo Basurto, operating NineWise ("we," "us," "our"), collects, uses, discloses, and protects personal information when you use ninewise.ca (the "Service"). We are committed to complying with the federal Personal Information Protection and Electronic Documents Act (PIPEDA) and, where applicable, British Columbia's Personal Information Protection Act (PIPA), to the extent these apply to our processing of Canadian users' personal information.
When you use the Speaking practice feature, NineWise collects an audio recording of your voice and a text transcription of that recording.

We do not sell your personal information to third parties.
Some of our service providers (including Anthropic, OpenAI, and Stripe) may process data on servers located outside of Canada, including in the United States. By using the Service, you acknowledge that your information may be processed in jurisdictions with different data protection laws than Canada's. We select providers that maintain appropriate safeguards for personal information.
We retain your account information and practice history for as long as your account is active. If you delete your account, we will delete or anonymize your personal information within 7 days, except where we are required to retain certain records (e.g., payment records) for legal, tax, or accounting purposes.

We use industry-standard safeguards to protect your information, including encrypted connections (HTTPS), database-level access controls restricting who and what can read or modify your data, and restricted access to production systems. No system is perfectly secure, and we cannot guarantee absolute security of information transmitted over the internet.
The Service is not directed at children under 18, and we do not knowingly collect personal information from anyone under that age. If you believe a child has created an account, contact us at hello@ninewise.ca so we can investigate and delete the account if appropriate.

This notice explains, in plain language, exactly what happens to your text and voice when you use NineWise's AI-powered practice features. It supplements the Privacy Policy and Terms of Service above.
The audio you listen to during Listening practice exercises is generated by NineWise using OpenAI's text-to-speech API from pre-written scripts. This direction does not involve any of your personal data — it is content we generate for you to listen to, not content generated from anything you provide.
NineWise does not build or host its own large language models. We use Anthropic's Claude API for scoring/feedback and OpenAI's APIs for speech-to-text and text-to-speech, because building equivalent technology in-house would be impractical for a service at our scale. Both providers are bound by their own API-level data processing terms, which (unlike their consumer chat products) generally do not permit using your submitted data to train their models.

Sprint purchases (Sprint 30 and Sprint 60) are one-time payments and are non-refundable, except under the Second-Attempt Guarantee described below, which applies only to Sprint 60.
When you purchase a Sprint, you receive immediate digital access: a set number of AI evaluations and a time-limited access window, both of which begin the moment your payment is confirmed. Because this access is granted instantly and the underlying AI evaluations have a real cost to us as soon as they're used, we are not able to offer refunds once a Sprint has been purchased and access granted.
If you purchased Sprint 60, you may be eligible for 30 additional days of access at no charge — not a cash refund — if all of the following are true:

If you believe you were charged incorrectly — for example, a duplicate charge, a charge without receiving corresponding access, or a technical error on our end — contact us at hello@ninewise.ca with your payment confirmation. We review these requests individually and in good faith, and may issue a refund or credit at our discretion where a genuine error occurred on our end.
The free plan has no charge and therefore nothing to refund. If you experience a technical issue that prevents you from using your free trial evaluations, contact hello@ninewise.ca and we will look into restoring your access.

Failing the CELPIP costs you more than the price of a retake — it can mean months of delay in your Express Entry or PR timeline. This is our way of sharing that risk with you.
If you complete a Sprint 60, sit the official CELPIP exam, and miss your target band in Writing or Speaking, we'll give you 30 extra days of NineWise access — free.
We built NineWise because we believe focused, personalized practice meaningfully improves CELPIP outcomes. But exams have a human element no tool can fully control. If our scoring told you that you were on track and the real exam said otherwise, the fairest thing we can do is give you more runway to close that gap — not just take your money and walk away.
